Pulte Homes Objects to Own Sales Brochure Being Turned Over To Jury As Evidence!

At the conclusion of our side of the case, a hearing was held to determine which of the evidence the plaintiffs (us) would be able to turn over to the jury to view during deliberations. The original sales brochure that Pulte put out listing the STANDARD FEATURES of their homes was one of our exhibits. Pulte objected to that brochure as evidence! Why? Let me quote the inside page paragraph on that brochure.

"Pulte Homes Corporation, the nations 2nd largest home builder, has been building the American Dream from coast to coast for 42 years. Quality, Value, and Design...that was William J. Pulte's philosophy when he built and sold his first home back in 1950. Since that time, many things have changed at Pulte Homes. Pulte Home Corporation, or PHM, as traded on the New York Stock Exchange (NYSE), incorporated on September 17, 1987, and is the publicly held parent company of the Pulte Homes Corporation group of companies. Although we are a large and growing company, we pride ourselves on the the traditional values that made us so great. Pulte continues to earn the title of America's Master Builder by providing Quality Workmanship, Innovative Home Designs and Value-Added Customer Service. Come see what were all about. Come see the Pulte Difference."

Now why would'nt they want the jury to see that? The rest of the brochure depicts the variety of houses they have to offer in our development. On the inside back page is the list of Standard Features. We had a copy of that on a separate paper that was signed by my wife and the sales representative and dated. They objected to that being turned over to the jury also. The judge ruled in their favor, not allowing the brochure in as evidence, but over ruled the objection to the signed Standard Features paper. One might want to ask, why would a company want to hide this information from a jury? Is it a lie? Are they not proud of the standard features they offer? I do not understand why they would not want that jury to view those documents? Maybe if you understand you can e-mail me. View the Standard Features offered at the time of our purchase.
