Wife CHARITY 1/2 of my tract of land where on my house now
stands during her life & the other half to my Grandson DAVID
LOOKINBEE. After the death of my wife, my grandson DAVID LOOKA-
BEE is to have the balance of my land that I willed to my wife.
Also to my grandson, son of DAVID, & sons of CHRISTIAN all the
land whereon my son DAVID lives from a dogwood corner to a
poplar at the head of the millpond to be divided between the
sons of CHRISTIAN & DAVID. My negro woman CATY is to wait &
nurse on my wife whenever she is in need of her & she is to
work out as usual. The other two is to work with my grandson
DAVID LOOKINBEE so long as my wife lives & at her death my
grandson DAVID LOOKINBEE is to have his choice of all my negroes
& the others are to be sold & the money divided in five parts
to got to CHRISTIAN's children, JOHN's children, except his
daughter SALLY - she is to have no part, my daughter SUSANA's
children, son DAVID's children, with the exception of a note
on JAMES BRYAND. My waggon & 2 horses I leave on my place for
the use of my grandson DAVID & my wife. At the death of my
wife, my grandson DAVID is to have the waggon & two horses.
All the household furniture I give to my wife & at her death
all is to be sold & the money divided for my grandchildren.
My reason for willing all my property to my grandchildren is
that my sons has been disobedient to me. I therefore will my
son JOHN $1.00, my son DAVID $1.00 & my son CHRISTIAN $1.00 .
The plows, hoes, & harrows are to be left on the place for my
grandson & my wife to farm with, also four cows, all the hogs
& the sheep, the cotton machine to be left on my place to the
use of my wife & grandson DAVID. There is money belonging to
the heirs of my daughter SUSANA's sons from the estate of
GEORGE LOOKENBEE, dec'd. the sum of $32.97. Exec: Friends

In the name of God Amen! I John Luckbee of the County of Rowan & Providence
of N. Carolina, being very weak in body but of perfect mind & memory
thanks be given to God, calling to mind the mortality of my body, knowing
that it is appointed to all men once to die, Do make & ordain this my
last will & test. That is to say principally & first of all, I give
my soul into the hands of God, & my body to be buried in a decent christian
burial at the discretion of my executors, nothing doubting but at the general
resurrection shall recieve the same again through the mighty goodness of
God. And as touching such worldly estates whereisith it had so pleased God
to bless me in this life I order it as followed. First I leave to my
son George the home plantation & ten pounds out of the moveable property.
Next I leave to my wife Barbara all what is left so long as she keeps my
name, also she is to sell property for to educate the children, my
wife is to maintain the children out of the property & if my wife marries
she is to have a childs part & if she remains a widow till George comes
of age then she is to make sale & sell the property, one horse, two cows
& two beds & other furniture what is alowed by two men, also there
is a small tract of land & the half is David Lentz to have & the
other part is to be sold & divided as loos property among the Garleys
& after her decease her property is to be sold & divided amongest

In the name of God Amen. I, Adam Swicegood, being of perfect mind & memory blessed be Almighty God for the same do ordain & constitute this my last will & testament hereby revoking all others in manner & form following. I give & bequeath unto my beloved wife Cathrine my negro boy Alfred & my tract of land whereon I now live the plantation & the said boy to cultivate the said land so as to make a support for my said wife Catharine or should my said Alfred become stubborn my executors can hire him & said plantation out so as thereby to procure a sufficient support for my said wife Catharine, also I wish & desire that all my other property of whatsoever nature or kind be kept together for the support of my said wife Catharine unless what she may be willing to spare.2. I will & bequeath unto my son Phillip Swicegood the tract of land whereon I now live after the death of my said wife Catharine by him the said Phillip Swicegood paying over to my daughter Susanna Lookabill wife of John Lookabill the sum of thirty dollars. 3. I will and bequeath unto my son Andrew Swicegood the plantation whereon he now lives from the N.E. line where Peggy lives renting to Farabers line. 4th. I will and bequeath unto my daughter Peggy Leach the plantation whereon she now lives, also ten acres more lying on the north side of the main road. 5. I will and bequeath unto my daughter Polly Williams lands on Bounders Branch containing fifty acres except one acre where the gold mine is supposed to be. 6. I desire that my property that is not herein named & which my beloved wife can do without be sold & equally divided between my several heirs. I also desire that my negro boy Alfred be retained & hired out among my heirs except Catharine Young & John Lookabill. I wish my heirs to wit, Andrew Swicegood, Phillip Swicegood, Peggy Leach & Polly Williams to pay out of the hire of my said negro Alfred to Catharine Young & John Lookabee one months hire of said negro annually, 7th and lastly I nominate & appoint my trusty sons Andrew Swicegood & Phillip Swicegood sole executors of this my last will & testament in witness whereof I have hereunto set my hand & seal this 24 April, 1833.

I, Andrew Swicegood, being of perfect mind and memory,
I do make my last
will & testament. That "is to say first of all, I recommend my
soul to God,
who gave it and my body to be buried by my executors as they recommend, and
as trusting my worldly estate which God has blessed me with, I bequeath in
the following manner.
First, I leave to my wife, America, all my land
and my son Jesse Alien,
becomes twenty one years old, then the land to be divided, my wife
to have
half and the balance to be divided between my three youngest children, that
is
equally between Susanna Jane, Jesse Alien, and Eliza Ellen. At the
death of
my wife or if she gets married again, then the land is to go to the three
named above. I leave to Susanna, the little Negro girl named Clary,
to Jesse
Alien, the Negro girl named Edith, and to Eliza Ellen the Negro girl called
Nelly.
I also will to my beloved wife and family, one year provision to be laid
off in such case, where there is no will, I also will to my wife, my Negro
girl. Sally, until her death or if she gets married then Salty is to go to
my
three youngest children and all his offsprings. I also
will to my three
youngest children each two hundred dollars and also each
one a bed and
furnishings.
I also will to my son John Larry, two hundred dollars, son George, two
hundred
dollars, son Andrew, two hundred dollars, as for my sons
Adam, Phillip and
Alexander, I have given them land and made for them a deed for it. I
further
will to my three youngest children one hundred dollars. I also will
to my
grandchildren of son Adam, five dollars each. The balance of my Negroes
not
willed to be sold and all my property not named in the above will to be sold
and the money paid as named in the above will. Then the balance to
be divided
between all my children equally and my wife to have a child's part,
also
my son Adam children to have no part.
I appoint my son, Phillip, Executor of this my last will and testament,
this
first day of February one thousand eight hundred sixty, A.D.

I David Byerly of the county of Davidson and State of NC planter being very sick in body but of perfect mind and memory. Do make and ordain this my last will and testament. I give, devise and dispose of the same in the following manner:
FIRST-I give and bequeath unto my beloved wife Lucy Byerly the privilege of one room of my dwelling house of her choice for her proper use and livelihood during her natural life or as long as she shall remain a widow in my name.
SECOND-I give and bequeath unto my beloved son, George Byerly my land adjoining iti-hat I purchased from Isiah Fisher. I give and bequeath unto my son George Byerly one negro fellow of his choice out of my negroes and also my large wagon and all the horse harness belonging to the same and also all my farming utensils of every denomination. I give to my son George Byerly the above mentioned property for his own proper use and livelihood also give and bequeath to my son George my two stills and all my still tubs and other implements belonging to the same, also I give to my son George one bed and furniture and my chest and my desk and my wearing apparel for his proper use and behalf.
THIRD-I give and bequeath unto my beloved daughter Sarah Byerly my negro girl named Nancy for her proper use and behalf also I give to my daughter Sarah Byerly my sorrel mare and my will is further that my daughter Sarah Byerly shall have an equal share out of my stock and household and kitchen furniture as my daughters that are now married have received.
FOURTH-My will is that my son George Byerly shall one year after my decease pay $100 to my granddaughter Eliza Byerly a daughter of my son Phillip Byerly, deceased or to her guardian out of the above estate which is already willed to the said George Byerly for her proper use and behalf.
FIFTH-I give and bequeath unto my beloved daughter Barbara Garner two negroes that is my negro girl Poll and my little negro boy named Joeda for her proper use and behalf.
SIXTH-My will ia that all my debts be paid out of my money on hand and the balance of my money on hand and the balance of my money in actual cash and notes to be equally divided amongst my wife Lucy and four of my children that is George Byerly, Catherine Capeley, Christina Collins and Sarah Byerly, my wife is to have an equal share with one of them and also my will is that all the grain and all the ardent spirits and all the meat that is now on hand George Byerly shall have the half thereof and my wife Lucy and my daughter shall have the half also. I give to my wife Lucy one horse of her choice, and if my above named wife should marry another man shall be entitled to receive one horse saddle and bridle, two cows, four head of sheep and her own bed, her chest, bureau, and her flax wheel and kitchen furniture as much as she may think proper for her own use and behalf.
SIXTH-My will is that after the decease of my beloved wife above named
all my property above willed to my beloved wife to be sold at public auction
and the proceeds there of to be equally divided amongst all my children that
is George Byerly, Barbara Garner, Catherine Capely, Christina Collins and
Sarah Byerly for their proper use and behalf and it is that my son George
Byerly shall find my wife Lucy in good diet during her natural life and during
her widowhood if they cannot agree at one table the said George to find her
as much as any two good men will say will do her. I do hereby constitute
and appoint my beloved son George Byerly sole executor of this my last will
and testament.

This is the will of John David Byerly. He died 30 Dec 1822 in Davidson Co.
NC. David Byerly was Married to Louisa Lukenbill 10 Apr 1775 in Rowan
Co. NC. David Byerly was appointed guardian of George Lukebey, son
of John & Barbara Lukebey after John Lukebeyís death in 1804 on
the
7 May 1805. Note the name of David Byerlyís children. Daughter Barbara
Garner was Davidís eldest daughter Anna Maria Barbara Byerly. She
was Married to Phillip Garner. Phillip was appointed guardian of Barbara
Lukebey on 7 May 1805, another child of John & Barbara Lukebey.
This means two of John & Barbara Lukebeyís children went to this
family.
