| Chocolate Celebrations, L.L.C ~ Rental Agreement ~
· Use of our 16", 19", 27" or 34" Chocolate Fountain · Four (4) pounds for the 16" fountain, (6) pounds for the 19" fountain, Ten (10) pounds for the small (27") fountain or twenty (20) pounds for the medium (34") fountain of premium Callebaut Belgian chocolate (choice of white, milk or dark chocolate) · Fountain attendant service to assist your guests at the fountain, maintain chocolate levels, refill dipping items and keep the area tidy *Note: When rented by itself, the 16" and/or 19" fountain is available for dropoff and pickup only. No attendant will be available · 2 hours of continuous flow time (start time as stated above) · Free set up (1 hour prior to event), maintain, and tear down of fountain for event within 30 miles of Dearborn, MI. If set up is required earlier than one hour prior to event, additional charges may apply. (For example, if set up is required at 12:00 p.m., but use of fountain will occur between 6:00 p.m. and 8:30 p.m.) · Unlimited skewers OPTIONAL: Travel charges for events outside a 30-mile radius of Dearborn Heights, MI will be added to the total. (Fee will be determined at the time of agreement). The distance is calculated using MAPQUEST online. Your caterer can provide dipping items or we can provide an assortment of dipping items according to which package you purchase. If Chocolate Celebrations is to provide dipping items with the Basic Plus or Premium Package, then the Food Provision Agreement must be signed and completed (FPA will be provided upon receipt of contract). Also available, when using our Basic Plus or Premium package, is our assortment of display platters, glassware and coordinating linens to beautifully add to your table. Let us take care of everything! PAYMENT TERMS: A $200.00 non-refundable deposit is required to reserve a small or medium Chocolate Celebrations Fountain. To confirm this agreement, return one signed and completed copy of this contract along with the $200.00 deposit. The balance is due NO LATER than 14 days prior to the event and can be paid in cash or check. ($25.00 fee for all returned checks.) Note: When renting by itself, the 16" or 19" fountain requires payment in full at contract signing Make checks payable to Chocolate Celebrations CANCELLATION: This agreement cannot be cancelled, except in writing, by either the Client or Chocolate Celebrations. If the client initiates the cancellation, Chocolate Celebrations will retain the non-refundable deposit paid at time of reservation. In case of the 16" or 19" Fountain rental, no refund will be provided. Client will hold harmless Chocolate Celebrations in the event of illness, injury, act of God or any other situation beyond the control of Chocolate Celebrations that prevents Chocolate Celebrations from performing. If no cancellation notification is given by the Client prior to an event date, the Client will owe the full remaining balance immediately. In the event Chocolate Celebrations must cancel the reservation for any reason, Client will be entitled to full return of deposit, and agrees not to pursue any other damages against Chocolate Celebrations or its owners resulting from the cancellation. PROVISIONS: Chocolate Celebrations requires access to the desired set-up area at least 1 hour prior to the start time. In addition, 45 minutes are required after the conclusion of the service period for take down and removal. The Client is responsible for providing a sturdy, level table capable of supporting at least 150 pounds. Client also agrees to provide two table linens that coordinate with the color scheme. Chocolate Celebrations will not be held liable for any chocolate which transfers to any linens or flooring surface whether provided by client, caterer or any other source. Chocolate Celebrations also requires at least 1 three-prong 110-volt grounded circuit within 10 feet of the desired set-up area that adheres to contemporary safety standards. Client accepts full responsibility and is liable for any damages, injuries or delays that occur as a result of failure to comply with these provisions. For the 16" or 19" Fountain rental, client assumes all responsibility for the setup of a level table capable of supporting at least 50 pounds. Chocolate Celebrations reserves the right to use any pictures from the event in advertising. LIABILITY: Client agrees to assume full responsibility and liability for any and all claims arising out of the use of the chocolate fountain and/or its fountain attendants. Chocolate Celebrations will not be held liable for any injury, allergic reaction, loss or damage directly or consequently arising out of the use and/or rental of the chocolate fountain and any food product provided for use with the chocolate fountain. Client will indemnify Chocolate Celebrations against, and hold Chocolate Celebrations harmless from all claims, actions, proceedings, costs, damages, and liability including attorney fees, arising out of, in connections with, or resulting from the rental of any fountain and/or food product provided by Chocolate Celebrations.
